    Eleonore’s husband, Henry Goudge, deserted her and her six children in October 1859 in Plymouth. Being unable to support herself and her children, she had to seek help from the overseers of the poor of the Parish of Charles, Plymouth.

    Parishes had a legal duty to support the poor, but only those who had residency or “settlement” in the parish.

    To determine whether a person had a legitimate right to residency, they were subject to a settlement examination. At this examination questions were asked and sometimes witnesses were called to corroborate the information.

    As a wife had the same settlement parish as her husband, it was determined that Eleonore’s place of settlement was the parish of Roche in Cornwall and a removal order was issued which required her and her children to be removed to Roche and be chargeable to that parish.

    The overseers of the poor in Roche appealed the decision and requested a copy of Eleonore’s marriage certificate to Henry Goudge from Jersey. Upon finding the certificate recorded her marrying John Brenton and not Henry Goudge, they consulted a solicitor who advised that using the wrong name did not invalidate the marriage and the appeal was withdrawn.
